Case #24-0018946
Initials & Country of Origin: S.U & K.G from Nicaragua
Type of Case: Affirmative
Language/interpretation needs: Spanish interpreter needed
Date of Entry (and status, if any): S.U 01/10/2024; K.G 04/20/2023, both with Nicaraguan Humanitarian Parole.
Current Status/status expiry: Asylum seekers (S.U principal & K.G derivative)
Ms. S.U. and her partner, K.G., are a lesbian couple from Nicaragua who have been targeted for their political opinions and sexual orientation. Ms. S.U. is a vocal human rights activist who, since her student years, has participated in protests against the Nicaraguan government and supported women’s and pro-choice advocacy groups. As a result, she was identified as a dissident, subjected to constant surveillance, and received repeated threats from police and state officials.
Both Ms. S.U. and K.G. have also endured severe persecution due to their sexual orientation. They have been publicly harassed, called homophobic slurs, had objects thrown at them, and were sexually assaulted in the street by men because they are a same-sex couple.
K.G. was additionally targeted due to imputed political opinion. Her mother, a former Sandinista community leader, withdrew from party involvement after the April 2018 events, leading authorities and community members to label the family as traitors. As a result, K.G. and her family were harassed through threatening calls and repeated police visits to their home.
K.G. also experienced persecution in her workplace at the Attorney General’s Office, where she was pressured to participate in ruling party activities. Due to her refusal and perceived political stance, she was subjected to ongoing harassment, surveillance, and scrutiny, including investigations into her relationship with Ms. S.U., further compounding the risk they face as both activists and a lesbian couple.
Note: Claim is strong but there are some challenges in the filing by the private attorney that need to be addressed. AHR will help you navigate these changes.
Theory of the Case: Past persecution and fear of future persecution by government actors and non-government actors on account of political opinion and membership in a particular social group (LGBTQ+)
Commitment: Review S.U's I-589 & File principal I-589 for K.G, collect evidence and testimony, appear for interview at USCIS; work permit (initial and renewals)
Interview: Yes
Experience level/case team size recommended: Appropriate for an attorney with some asylum experience.
