Ms. O.G.'s father has never been in her life or helped provide for her financially. He has denied being her real father on several occasions and has refused to be responsible for her wellbeing. Due to this, Ms. O.G feels she has been neglected by her father and has a poor relationship with him and is eligible for SIJS on that basis. She is now living with her mom in MN.
Asylum:
Ms. O.G. was the victim of a commercial sex trafficking network in MedellĂn, Colombia. Daughter was groomed through Facebook when she was 13 yo, she met another girl who was showing off brand name clothes, expensive items, etc. This girl informed daughter that she was working for extranjeros who were paying her for sex, and that they were looking for 4 more girls to join. Mom discovered her daughter was involved in this (through her son who saw the daughter's Facebook messages) and immediately reported it to the police on 05/29/2023. 6 months after this, the police report was leaked (unclear how), and the individuals in charge of the commercial sex network discovered who had reported them. As a result mom and her entire family were the target of consistent death threats via phone call. Mom stated the traffickers knew where their names, phone numbers, where they lived, where the kids went to school, where she worked, etc. They lived in hiding for many months throughout 2023 and into 2024.
Theory of the Case: SIJS based on abandonment, and neglect by father. Asylum based on fear of future persecution by non-government actors on account of membership in a particular social group (gender-based).
