Case #25-0079003

M.S from Guinea

Type of Case: SIJS and Defensive Asylum (Optional)

Language/interpretation needs: French (interpreter needed)

Date of Entry (and status, if any): 03/03/2024; UAC

Current Status/status expiry: N/A

Case Summary:
M.S experienced a lot of abuse and neglect by his stepfather, who is also his uncle. His father passed away when he was very young and, in his culture, when the father passes away, it is the father’s brother’s responsibility to care for his family and marry the widow. So, his uncle married his mother. Almost immediately, his uncle began abusing him mentally and physically. He forced him to work and if he returned home with no money, he would get beaten. If he didn’t do something his uncle wanted him to do, he would get beaten. He was forced to drop out of school, was sometimes not allowed to eat, forced to sleep on the concrete floor, and beaten with cords, leaving him with many scars. M.S's mother was unable to stop the abuse because she would also be subjected to the same abuse if she intervened.

Theory of the Case: SIJS eligible based on abandonment by father and neglect from mother as she was unable to intervene Mr. M.S' uncle from abusing him.

Commitment: SIJS--Review predicate order, file I-360

Interview Y/N: No

Court Y/N: Yes, but unlikely

Experience level/case team size recommended: Appropriate for any experience level and team size
